What is a rental agreement and why do I need one in Kenya?
A rental agreement is a legally binding contract between a landlord and a tenant that sets out the terms for renting a home — the rent, the deposit, the term, who pays utilities, and each party's rights and responsibilities. In Kenya, a clear written agreement signed before witnesses protects both sides: the landlord has a clear right to the rent and the property back in good condition, and the tenant has secure occupation on known terms.
Can I choose between a month-to-month and a fixed-term tenancy?
Yes. The template has a tenancy type selector. Choose month-to-month for a rolling tenancy that continues until either party gives notice, or fixed term and set the number of months and the end date. Both use the same rent, deposit and other terms, so you only change the term details.
How much is the deposit, and when is it refunded?
You set the security deposit in KES — commonly one month's rent — payable on signing. The template provides for it to be refunded within the number of days you set (30 by default) after the tenancy ends, subject to an inspection and to deductions for any damage or unpaid rent. Keeping a simple inventory at move-in makes settling the deposit fairer.
Who pays for utilities and repairs?
Under this form the tenant pays for electricity, water, garbage and other utilities, and keeps the home clean and in good condition. The landlord handles structural repairs and can list any utilities they choose to cover. Any damage caused by the tenant is repaired at the tenant's expense.
How much notice is needed to end the tenancy or enter the home?
Either party can end the tenancy by giving the written notice you set (30 days by default), after which the tenant vacates and returns the keys. For inspections or repairs, the landlord must give at least the notice you set (24 hours by default), except in an emergency.
Is this rental agreement valid in Kenya, and do I need witnesses?
Yes — it is written for Kenya, uses KES, and is governed by the laws of Kenya. It includes space for two witnesses, which is standard practice and helps with enforceability. Note that some residential tenancies are protected under the Rent Restriction Act (Cap 296), with disputes going to the Rent Restriction Tribunal, so for protected or higher-value tenancies check the position or ask a local advocate.
