What is a lease agreement, and what property does this template cover?
A lease agreement is a legally binding contract in which a landlord lets property to a tenant for a fixed term in return for rent. How does the rent and annual escalation work?
The tenant pays rent monthly in advance on a day you choose, and the template includes an annual escalation — the rent increases by a percentage you set (for example 7%) on each 12-month anniversary of the effective date. Rent for any partial period is prorated, and you can set your own first-payment and late-fee terms, so the rent section matches the deal you have agreed.
Can I use it for a ground lease where the tenant builds on the land?
Yes. The template is designed with ground leases in mind. It lets the tenant make improvements (with the landlord's written approval) and grant a leasehold mortgage to finance construction, while protecting the landlord's interest from being pledged or subordinated. Improvements become the landlord's property at the end of the term, which is the usual ground-lease arrangement.
Who pays taxes, utilities and for repairs?
Under this template the landlord pays taxes and assessments on the site, while the tenant pays for utilities and keeps the site in good repair at its own expense. The tenant also handles permits, compliance with laws, and insurance for its improvements and property. You can add or adjust these allocations in the additional-terms field if your deal is different.
What happens on default, holdover or termination?
An event of default includes missing a set number of consecutive payments (you choose how many), breaching a term, or insolvency. Either party can terminate after a cure period you set following written notice. If the tenant stays on after the term, a holdover rate (a percentage of the rent you set) applies. On termination the tenant must surrender the site in good repair and remove its property within the stated periods.
Which law governs the agreement, and how are disputes resolved?
You choose the governing law and the arbitration body, so the template is not tied to one country. Disputes go first to mediation and, if unresolved, to binding arbitration under the rules of the body you name. The template also provides for the lease to be registered with the relevant government office where local law and practice require it — check your local rules, as registration and stamp duty vary.
