What is a residential rental agreement?

A residential rental agreement is a legally binding contract between a property owner and a tenant that sets out the terms for renting a home ; the rent, the tenancy period, the security deposit, maintenance charges, and each party's rights and responsibilities. Once signed (and registered, where required), it governs the rental relationship.

What's the difference between rent and the maintenance charge?

Rent is the amount you pay for the right to occupy the property. The maintenance charge is a separate monthly amount covering shared services and upkeep; the generator and elevator, security guards' salaries, electricity for common areas, common-area cleaning, and lawn maintenance. Keeping them separate makes it clear what each payment is for.

Is the security deposit refundable?

Yes. The deposit is an interest-free, refundable amount (paid by cheque at signing). It's returned when the tenant hands back possession at the end of the tenancy, after adjusting any dues or the cost of damage caused by the tenant's negligence; normal wear and tear and damage from an act of God are excluded. The template also protects the tenant: if the owner fails to refund the deposit, the tenant may hold possession, rent-free, until it is refunded.

Can the tenant sublet or make changes to the property?

No subletting or assigning is allowed — the premises must be used for bona fide residential purposes only. The tenant also can't make structural additions or alterations without the owner's prior written consent, though they may install air-conditioners and other electrical gadgets at their own cost and remove them (restoring the original state) when the tenancy ends.

Who is responsible for repairs?

Day-to-day minor repairs — such as leaks in sanitary fittings, taps and routine electrical items — are the tenant's responsibility at their own expense. Any structural or major repairs are carried out by the owner. All fittings, fixtures and appliances are handed over in good working condition at the start.

How can the agreement be terminated, and what if the tenant doesn't move out?

Either party may terminate before expiry by giving the agreed written notice (for example, one month). If the tenant fails to vacate at the end of the tenancy, they must pay holdover damages (for example, twice the rent) for the overstay period — and the owner can still take legal action to recover possession.

What is Annexure-I, and why does it matter?

Annexure-I is a property inventory attached to the agreement — it lists the rooms and the fittings and fixtures handed over (bedrooms, fans, lights, geysers, mirrors, and so on). Recording the inventory at move-in protects both parties: it's the reference point for assessing damage and settling the security deposit when the tenant moves out.

Does this rental agreement need to be registered?

This template includes a clause providing that the agreement is registered before the Registrar, with stamp-duty, court-fee and lawyer/coordinator charges shared equally by owner and tenant. Whether registration is mandatory — and the stamp-duty payable — depends on your local law and the tenancy length, so check your city's rules or ask a local lawyer.
