What is a power of attorney, and who are the donor and the attorney?
A power of attorney is a legal document in which one person (the Donor) authorizes another person (the Attorney, also called the donee) to act on their behalf. The Donor is the person giving the authority; the Attorney is the person trusted to use it. It is commonly used to let someone manage your finances, property or a specific transaction — for example while you are travelling, unwell, or unable to attend in person.
What is the difference between a general and a specific power of attorney?
A general power lets the Attorney do broadly anything you could lawfully do through an attorney. A specific (or limited) power restricts the Attorney to particular tasks you list — such as selling one property, operating a bank account, or signing a specific contract. What is an enduring (durable) power of attorney?
An ordinary power of attorney automatically ends if the Donor loses mental capacity. An enduring (or durable) power is designed to continue even then, so the Attorney can keep helping. This template lets you choose which one you want. Enduring powers are the most heavily regulated type and often need special wording, witnessing or registration, so check your local rules or a lawyer before relying on one.
How is a power of attorney signed and witnessed?
This template is drafted as a deed and includes a signing block for the Donor with space for two witnesses (name, address and occupation), plus an optional acceptance by the Attorney. Signing before independent witnesses helps make the document valid and reliable. Some jurisdictions also require notarization or registration — particularly for property matters or enduring powers.
Can the donor cancel (revoke) the power of attorney?
Yes. While the Donor has mental capacity, they can revoke the power at any time by written notice to the Attorney. The power also ends automatically on the Donor's death, bankruptcy or insolvency, and (unless it is an enduring power) on the Donor's loss of mental capacity. On revocation, the Attorney must stop acting and return any documents and property held under the power.
Is this power of attorney valid in any country?
It is written in plain, common-law style and is not tied to one country, so you choose the governing law. However, power-of-attorney rules — especially for enduring powers and property dealings — vary widely and can require specific formalities to be valid.
