About this template

A South African lease agreement you can customize and download in minutes

A lease agreement is the contract a landlord and a tenant sign to lease property. This template is a comprehensive, plain-English format governed by South African law, and a property-type field lets you adapt it to lease a building, land or grounds - from offices and warehouses to commercial plots, yards and ground leases. Local references are built in: rent is in ZAR, amounts are stated exclusive of VAT, the lease is registered against title at the Deeds Office where a long lease requires it, the agreement is governed by the laws of the Republic of South Africa, and disputes go to arbitration under the Association of Arbitrators (South Africa) (AASA).

Just answer a few simple questions - the landlord's and tenant's details, the property and its permitted use, the term, the rent and annual escalation, and your commercial terms - and your personalized South African lease is generated instantly, ready to download as PDF or Word.

Disclaimer: This template is provided for convenience and general information only and is not legal advice. South African rules on lease registration (Deeds Registries Act; Formalities in Respect of Leases of Land Act), VAT, transfer duty, the National Credit Act and municipal rates can change and depend on the property and the length of the lease. For long leases, ground leases with construction, or high-value deals, have the final agreement reviewed by a qualified South African attorney before signing.

Frequently asked questions
What is this South African lease agreement for?

It is a legally binding contract in which a landlord leases property to a tenant for a fixed term in return for rent, governed by the laws of the Republic of South Africa. A property-type field and a free-text legal description let you use it to lease a building, land, grounds (such as a yard or plot), or land together with a building β€” it suits offices, warehouses and standalone premises as well as ground leases and commercial sites, all under South African law.

Is the rent in ZAR, and does VAT apply?

Yes. The rent is stated in South African Rand (ZAR) and is paid monthly in advance, with an annual escalation you set. The template states that rent and other amounts are exclusive of VAT, which the tenant pays in addition where it is chargeable β€” a common arrangement for commercial leases in South Africa. You still set the rent figure, escalation rate, due day and first-payment terms.

Does the lease need to be registered at the Deeds Office?

For a long lease of land, South African practice is to register the lease against the property's title at the relevant Deeds Office (under the Deeds Registries Act and the Formalities in Respect of Leases of Land Act) so it binds future owners. The template includes a registration clause with a period you set. Whether registration is required depends on the length of the lease, so check with your conveyancer.

Can I use it for a ground lease where the tenant builds on the land?

Yes β€” the template is built with ground leases in mind. The tenant may make improvements (with the landlord's written approval, in line with the National Building Regulations) and grant a leasehold mortgage to finance construction, while the landlord's interest is protected from being pledged or subordinated. Improvements become the landlord's property at the end of the term.

Which commercial terms can I change?

The jurisdiction-specific parts β€” South African law, ZAR, VAT, Deeds Office registration and AASA arbitration β€” are fixed so the document stays correct for South Africa. Everything commercial is yours to set: the parties, the property and permitted use, the term, the rent and annual escalation, the first-payment, late-fee and deposit terms, the holdover rate, the number of missed payments that trigger default, the cure period, and any additional terms.

How are disputes resolved?

Disputes go first to mediation, and if that fails, to binding arbitration under the rules of the Association of Arbitrators (South Africa) (AASA). The agreement is governed exclusively by South African law. For high-value or long leases, it is still wise to have a South African attorney review the final document before signing.
