What is a tenancy agreement?
A tenancy agreement is a legally binding contract between a landlord (or their managing agent) and a tenant. It sets out the rent, the length of the tenancy, and each party's rights and responsibilities; such as who pays for repairs and utilities, how the property may be used, and how the tenancy can be renewed or ended. This template covers all of these for a facility-managed apartment.
What's the difference between rent, service charge and caution fee?
Rent is the annual amount you pay to occupy the apartment, usually in advance. The service charge is a separate, non-refundable yearly fee that covers estate upkeep; the property manager's salary, common-area cleaning and grounds maintenance. The caution fee is a refundable deposit held against damage; it's returned when you move out, minus the cost of restoring the apartment to the condition it was in when you moved in.
Is the caution fee refundable?
Yes. The caution fee is refundable at the end of the tenancy, subject to deductions for putting the property back into the condition it was in when the tenant moved in. To make this fair, both parties confirm a fixtures inventory at the start; the walls, tiles, wardrobes, door locks, windows, and electrical and plumbing fittings; which is checked again at move-out.
What happens if the tenant pays rent late?
Under this template, if rent is not paid within the agreed grace period (for example, 21 days) after the due date, a monthly penalty applies. If rent stays unpaid beyond a further period (for example, 30 days), the landlord may re-enter and recover possession of the premises, and the tenant may be liable for legal recovery costs.
Can either party end the tenancy early?
Yes. Either party may terminate before the tenancy expires by giving the agreed written notice (for example, three months), or by paying an equivalent amount of rent in lieu of notice. The landlord also keeps the standard right to re-enter the premises if the tenant seriously breaches the agreement.
How does renewal work?
The tenancy is for a fixed term. If the tenant wants a new term, they must notify the landlord in writing before the current term ends (for example, not less than three months before expiry). The landlord may then grant a fresh one-year tenancy at a rent reflecting current market conditions, on the same terms; but renewal is at the landlord's option, and this remains a fixed-term (not a periodic) tenancy.
Can notices be sent by WhatsApp?
Yes. This template expressly allows the landlord (or the authorized agent) to notify the tenant of a rent increase in writing, and where written notice isn't practicable, to send it via the tenant's WhatsApp number or other electronic means used to communicate with them. Formal notices may also be left at the premises or sent by registered post.
Is this tenancy agreement legally binding, and does it work in all states in Nigeria?
Once both parties sign (with witnesses), it is a binding contract. The template is jurisdiction-agnostic; you set the governing law — so it works across Nigeria. Bear in mind that some states, such as Lagos and the FCT, have their own tenancy laws affecting notice periods and advance rent, so for high-value lettings it's wise to have the final agreement checked by a local lawyer.
